FortunAI Terms of Service

FortunAI ("we," "us," or "our") provides personalized guidance through a mobile application combining traditional Eastern astrology with modern technology. By accessing or using FortunAI, you agree to these Terms of Service ("Terms"). Continued use constitutes acceptance of future revisions.

User Rights and Responsibilities

Account Creation and Security

Users must provide accurate information during registration, including name, email, and birth details. You are responsible for maintaining account confidentiality, including passwords, and must notify us immediately of unauthorized access. Sharing accounts or credentials is prohibited.

Age Restrictions

FortunAI is intended for users 18 years or older. Users between 13-17 years may access the service only with verifiable parental/guardian consent. We do not knowingly collect information from children under 13. If we discover we have collected information from a child under 13, we will delete that information immediately.

Prohibited Uses and Behaviors

You may not use FortunAI for unlawful activities, harassment, fraud, or spreading malicious software. Content must not infringe intellectual property, promote hate speech, or violate privacy rights. Automated scraping of app content or reverse engineering is strictly forbidden.

User-Generated Content Guidelines

While FortunAI does not host public user content, any feedback or submissions become our property. You grant us a non-exclusive license to use such content for service improvements.

Account Termination Conditions

We reserve the right to suspend or terminate accounts for breaches of these Terms, fraudulent activity, or harmful behavior. Users may request deletion via app settings, subject to data retention policies.

Accuracy Disclaimers

While we strive for meaningful insights, outcomes may vary based on personal circumstances. We do not guarantee the accuracy, reliability, or completeness of daily readings.

Service Availability

FortunAI aims for 24/7 availability but may experience downtime for maintenance, updates, or unforeseen outages. Premium subscribers receive priority support during disruptions.

Force Majeure

Neither party shall be liable for failures or delays resulting from circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, pandemic, terrorism, riots, wars, telecommunication failures, cloud service provider outages, or governmental restrictions. Service interruptions due to such events do not constitute grounds for refunds or termination.

Privacy and Data Handling

Data Collection and Use

We collect:

• Personal Data: Name, email, birth details (date, time, location) for personalized readings.
• Usage Data: Reading preferences, regeneration frequency, and interaction patterns to improve AI models.

Data is used solely for service delivery and never sold to third parties.

Data Retention and Deletion

User data is retained until account deletion. Upon request, we permanently erase personal information within 30 days, except as required by law.

Third-Party Providers

Payment processing is handled by Stripe, which collects billing information under its Privacy Policy. We use AWS for secure data storage and Google Analytics for usage trends.

User Data Rights

Under GDPR and CCPA, users may:

• Correct inaccuracies in birth details.
• Opt out of non-essential data processing.

Enhanced Privacy Protections

Data Security: We implement industry-standard technical, administrative, and physical safeguards to protect your personal information. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

Corporate Transactions: In the event of a merger, acquisition, or sale of all or a portion of our assets, user data may be among the transferred assets. We will notify users via email and/or prominent notice on our service of any change in ownership or uses of personal information.

Data Anonymization: When data is anonymized for research or service improvement, we employ technical safeguards to ensure that re-identification of individuals is not reasonably possible.

Subscription Terms

Billing and Payments

Subscriptions auto-renew monthly. Fees are charged via Stripe on the registration date. Failed payments result in immediate downgrades to the free tier.

Cancellations and Refunds

Cancel anytime through app settings or Stripe's dashboard. No refunds are issued for partial months. Exceptions apply where required by local consumer laws.

Tier Changes

Upgrades take effect immediately; prorated charges apply. Downgrades begin at the next billing cycle.

Price Changes

We reserve the right to modify subscription prices with at least 30 days' notice for existing subscribers. Changes will be communicated via email and in-app notifications.

Promotional Rates

Any discounted or promotional subscription rates are temporary unless explicitly stated otherwise. Upon conclusion of promotional periods, standard rates automatically apply.

Trial Conversions

Free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled at least 24 hours before the trial ends. Users are responsible for cancelling trials if continued service is not desired.

Intellectual Property

Ownership

All app content, including readings, algorithms, and design elements, is owned by FortunAI. Users receive a limited, non-transferable license for personal use.

Copyright Protections

Unauthorized reproduction of readings, AI models, or zodiac analyses violates copyright laws. Attribution is required for permitted sharing.

AI Model Protection

Users are prohibited from using FortunAI outputs to train, develop, or improve competing AI models or services. Any attempt to reverse engineer our AI systems or extract training data constitutes a material breach of these Terms.

Derivative Works

All improvements, adaptations, or derivative works based on user feedback or interaction patterns automatically become our exclusive property, even if suggested by users.

Content Licensing

The limited license granted to users is non-transferable, non-sublicensable, and may be revoked at any time for Terms violations. Users may not reproduce, distribute, or create derivative works from readings without explicit written permission.

Limitation of Liability

Service Disclaimers

FortunAI is provided "as is." We disclaim warranties for merchantability, fitness for purpose, or non-infringement. Use of guidance is at your sole risk.

Liability Cap

Our total liability for claims is limited to fees paid in the preceding three months. We are not liable for indirect, incidental, or punitive damages.

Enhanced Liability Limitations

Decision Disclaimer: You acknowledge that any financial, career, relationship, or life decisions made based on FortunAI readings are entirely your responsibility. Our service is for entertainment and self-reflection only, and we expressly disclaim liability for outcomes resulting from actions taken based on readings.

Technical Issues: We are not liable for any damages arising from temporary unavailability, data transmission errors, or technical inaccuracies in readings due to device compatibility, internet connectivity, or algorithmic variance.

AI-Generated Content: Due to the nature of AI technology, we cannot guarantee specific results or that generated content will be error-free, completely unique, or free from unintended biases despite our best efforts.

Indemnification

You agree to indemnify us against losses from Terms violations, misuse of readings, or unauthorized account access.

Dispute Resolution

Governing Law

These Terms are governed by Delaware law, excluding conflict-of-law principles.

Arbitration

Disputes must be resolved through binding arbitration under AAA rules. Class actions and jury trials are waived.

Arbitration Specifics

Arbitration will be conducted in English by a single arbitrator in Delaware. Each party will bear its own costs of arbitration, with the arbitrator's fees split equally unless otherwise required by law. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Statute of Limitations

Any cause of action arising out of or related to the service must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

Legal Formalities

Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.

Assignment

You may not assign these Terms or any rights or licenses granted hereunder without our prior written consent. We may assign our rights and obligations under these Terms, in whole or in part, to any party at any time without notice or consent.

Export Control

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control, and the International Traffic in Arms Regulations maintained by the Department of State.

Waiver

No failure or delay by FortunAI in exercising any right under these Terms shall operate as a waiver of that right. No single or partial exercise of any right shall preclude any other or further exercise of that or any other right.

Modifications to Terms

Updates

We may revise Terms periodically. Continued use after changes constitutes acceptance.

Notifications

Material changes are communicated via email or in-app alerts 30 days before taking effect.

Entire Agreement

These Terms constitute the entire agreement between you and FortunAI regarding your use of the service, superseding any prior agreements between you and FortunAI (including, but not limited to, any prior versions of the Terms).
